Bill Davis Racing sues sponsor 360 OTC for non-payment

Bill Davis Racing alleges that Rockford-Montgomery Labs has paid only $25,000 of the $14 million it was supposed to pay for sponsorship of the No. 36 Cup entry last season, according to a lawsuit filed April 2 in North Carolina Superior Court in Winston Salem, N.C.
RML is the maker of 360 OTC, a line of hangover and headache medicine.
The sponsorship was a three-year deal that was scheduled to increase to $14.5 million in 2008 and $15 million in 2009. There was a
sponsor’s option for 2010 for $15.5 million.
According to the lawsuit, RML also did not pay any of the $3 million it owed as a primary sponsor for the No. 36 truck and $1 million it owed to be primary sponsor for 10 races of the No. 23 truck.
“Bill Davis [Racing] is a wonderful bunch of people and a wonderful race team, and it is a shame that this has happened,” BDR attorney John Morrow said.
This is the latest in a series of lawsuits against RML, which has been sued by Just Marketing, which was handling the NASCAR sponsorship, as well as by the World of Outlaws and World Wrestling Entertainment. An attorney who represents RML in the World of Outlaws and the WWE case did not immediately return a request for comment.

Jacques Villeneuve says he's using the final two events of the Speedcar Series to try and rustle up some sponsorship to keep his NASCAR dream alive. The former Formula One champion is competing in the series which is a stockcar-style competition featuring identical 620 horsepower cars based in the Middle East.
Villeneuve says still has a few months to find the necessary budget to get back into the Sprint Cup series this year but admits it won't be easy. He started the year with Bill Davis Racing but after failing to qualify for the Daytona 500, he was eventually dropped due to a lack of sponsorship.
He plans to drive for Peugeot at the 24 Hours of Le Mans later this summer and will race at Spa next month in preparation for that event. He also hopes to be competing in the NASCAR Nationwide Series race in Montreal. His long term goal is to secure the necessary financing for a full time Sprint Cup ride in 2009. (From TSN.ca)

Former Formula One racer and Red Bull Racing Team development driver Scott Speed will drive a fourth Bill Davis Racing Toyota in select NASCAR Craftsman Truck Series races this season. Red Bull, Speed's sponsor, wants to give the American more track time in an effort to advance his stock-car career.
Speed, who returned to the United States after he lost his F1 ride toward the end of last year, will make his Bill Davis Racing debut at Kansas Speedway on April 26, followed by entries at Lowe's Motor Speedway (May 16), Dover (May 30), Michigan (June 14), Bristol (Aug. 20), Talladega Oct. 4), Martinsville (Oct. 18), Atlanta (Oct. 25), Texas (Oct. 31), Phoenix (Nov. 7) and Homestead-Miami (Nov. 14).
The California native has already run two truck races this season, driving a Morgan-Dollar Motorsports Chevrolet to finish 27th at Atlanta in March and 10th this past weekend at Martinsville. In addition to his truck duties, Sharp will continue to drive Eddie Sharp Racing's No. 2 Red Bull Toyota full time in the 2008 ARCA Series.
"This is a great opportunity for me to work closely with Skinner while I get my feet wet in the truck series," Speed said. "He knows what it takes to run well and win races, and that's a hell of a mentor for me to have. The more I can learn from him, the quicker my learning process will be in these trucks."

BAM Racing is switching to Toyotas beginning this weekend at Martinsville Speedway, team spokesman Rhett Vandiver says. “After being with Dodge for seven years, we looked around and evaluated all the manufacturers, and we just found Toyota to be most committed to racing and the one that would benefit our program the best,” Vandiver said Wednesday.
The team, which fields the No. 49 entry for Ken Schrader, also announced that Microsoft, through its small-business program, will be the primary sponsor for Martinsville and an associate sponsor for the rest of the season. BAM Racing offers small businesses a sponsorship package that can start at $4,995.
Bill Davis Racing is also working with BAM Racing on the transition from Toyota to Dodge, Vandiver said. (From SceneDaily.com)
